You would need to test the thermal cut out with a multimeter to determine if it has failed.

Many combination top ovens do as the oven thermostat will shut off if the cavity temperature exceeds 250C. Make sure the cavity is well ventilated and clean.

If the circulation and cooling fans are working correctly and there is adequate air circulation then replacing this part may cure your problem.
Top oven was left on melting the door seal. The grill still works but the oven isn't heating up. Everything is fine with the main oven. Could it be that the thermal cut out needs replaced Any advice would be appreciated.

This thermal cut out is a 'link' that breaks if excess heat builds up and is likely to have gone open circuit. check with a meter for continuity and replace if it is 'open circuit'.
my indesit top oven element blew up, i have changed the element but now the grill function wont work, only the top oven, is this the "energy regulator"? im a qualified electrician so if further test need to be completed I will do so, I have only so for changed the element and haven't ripped it open yet!

The cut out or the selector switch is likely to be faulty. Check when you have sorted out this fault that the main oven thermostat cuts out as if it has welded the contacts it may cause it to overheat and trip the cut out again.
